The Carver County Board of Adjustment is established and invested with authorities as provided by Minnesota Statutes 394.21 through 394.37. Within the Carver County zoning code, Chapter 152 establishes the roles and responsibility of the Board of Adjustment, which can be amended from time to time.

About the Board of Adjustment

  • The Board of Adjustment consist of seven members, one which is a member of the County Planning Commission whose term coincides with the term they have on the County Planning Commission.
  • The members of the Board of Adjustment shall be appointed by the Board of County Commissioners.
  • There shall be at least one member from the unincorporated areas of the County. 

Roles and responsibilities

The Board of Adjustment has the exclusive power to review variance requests and appeals related to the zoning code, subdivision ordinance, signage regulations, subsurface sewage treatment system ordinance, and feedlot ordinance. The Board conducts public hearings and makes decisions by the adoption of an order either approving or denying the variance or appeal.  All decisions by the Board of Adjustment in granting variances or in hearing appeals from any administrative order, requirement, decision, or determination are final.

Responsibilities

  • Review and decide on variance applications from residents and businesses who, based on unique circumstances, request flexibility from the strict application of zoning code standards.
  • Review and decide on appeals of decisions made by the County Zoning Administrator.

Current Board of Adjustment Public Hearing Notices

Meetings are scheduled for the first Wednesday of every month. Meetings are canceled if there are no agenda items. 

Agendas and times are subject to change without prior notice - items may be added or deleted during the agenda adoption process.
