Tax Forfeiture Sale

The name of the person or organization that purchased the property must appear on the deed. They can, however, include another person’s name (i.e. spouse, friend, etc.). You will need to indicate if you want the property in joint tenancy or tenants in common. We require social security numbers for all owners of parcels purchased.

Yes, if you are a legal representative for the individual or organization. A legal representative would be an attorney or someone who has Power of Attorney authorization for the individual.

The following individuals (either personally or as an agent or attorney for any other person):

County Auditor/Treasurer, District Court Administrators, County Assessors or supervisors of assessments, land commissioners or assistant land commissioners for tax-forfeited lands, any deputies or employees of any of the above individuals. (MS 282.016)  These individuals are further prohibited from having another person directly or indirectly purchase tax-forfeited land on their behalf for their benefit or gain.  Relatives of these prohibited purchasers may purchase land at a tax-forfeited land sale unless the relative is buying the property for the prohibited person.

Potential purchasers who own property in Carver County but are delinquent on their property taxes are restricted from purchasing at the sale.  In addition, if you are the owner who lost that property due to non-payment of taxes, you will not be allowed to bid on the property at the sale. 

No. Any further questions on the taxable market value of the property should be directed to the Carver County Assessor’s office at (952) 361-1960.

No. The delinquent taxes have been cancelled. The amount you will need to pay for your property is the purchase price along with other fees and costs.

Carver County makes no warranty that the land is buildable. The property may not conform to local building and zoning ordinances. You will need to check with the city zoning office (if in city limits of a city) or Carver County Land Management (if the property is in a township) at (952) 361-1820 for this information.

No. All sales are final and no refunds or exchanges are permitted.

No. Tax forfeiture will create a break in the chain of title, and services of an attorney may be necessary to make the title marketable. All sales are subject to existing leases and building restrictions appearing of record at the time of forfeiture and to easements obtained by any governmental subdivision or agency for public use. All property is sold "AS IS."

Yes, once the title is in your name. The following year property tax statement will be mailed to you in March and the Proposed Tax Notice (aka Truth in Taxation Notice) in November.

Yes. If a tax forfeited parcel had cancelled special assessments, as indicated by an asterisk (*) on the Notice of Public Sale, they can be re-applied to the parcel. The municipality may reassess any remaining balance. Any agreement on this balance is between you and the taxing authority that certified the special assessment. In approximately 90 days after the paperwork is completed and it has been filed with the Carver County Recorder’s Office. We record the State Deed for you.
